Starting with 17.01.2022, Law no. 22 / 14.01.2022 for the amendment and completion of the Government Emergency Ordinance no. 194/2002 on the regime of foreigners in Romania, defines the digital nomad and the immigration process applicable in Romania.
Thus, a digital nomad is a Non-European citizen who is employed based on an employment contract to a company registered outside Romania and who provides services through the use of information and communication technology or who owns a company registered outside of Romania, in which he/she provides services through the use of information and communication technology and may carry out the activity of employee or activity within the company, remotely, through the use of information and communication technology.
The immigration process involves obtaining a long-stay visa (other purposes type D/AS) and a temporary residence permit, that can be extended.
The long-stay visa is granted, upon request, to digital nomads who wish to travel and stay in Romania, if a series of conditions are cumulatively fulfilled, in addition to the standard documents for applying for the long-stay visas, such as:
- proof of lucrative activities outside of Romania in the software field for at least 3 years prior to applying for a Romanian visa,
- present a tax clearance certificate from the state of origin / residence,
- proof of the means of subsistence at the level of at least 3*the average gross monthly salary / economy, for 6 months prior to the visa application as well as for the entire period registered in the visa. In 2022, the average gross salary/economy amounts Ron 6,095 in Romania.
The first residence permit will be granted for a period of 6 months, according to art. 69 para. 7 of GEO no. 194/2002.
Subsequent extensions of the right of temporary residence may be granted if the foreigner will continue to meet the conditions provided by the law and if he/she will present an income certificate issued by the territorial Romanian Tax Office.
Romania ranks first in all rankings regarding the attractiveness of digital nomads, relying on a very good speed of broadband internet, as well as low living costs, compared to other European countries. Visas for digital nomads are also granted in Europe, in Germany, Estonia, the Czech Republic, Portugal, Croatia and Norway.
